1. Acceptance of Terms

By accessing or using the Color My Classics website (colormyclassics.com) or placing an order, you agree to be bound by these Terms of Service and our Privacy Statement. If you do not agree, please do not use the service.

These terms constitute a legally binding agreement between you and Fun-o-matic Labs LLC ("we," "us," or "our"), a limited liability company based in New York City, NY.

2. Who May Use This Service

You must be at least 18 years old to place an order or use this service. By using Color My Classics, you represent that:

Color My Classics is intended to be ordered by adults for the children in their lives. The service is not directed to children under 13, and we do not knowingly collect information directly from children.

3. The Service

Color My Classics is a custom print-on-demand service that creates personalized coloring books for children. When you place an order, you:

  1. Upload a photograph of a child
  2. Provide the child's first name and select a story adventure
  3. Our system generates a custom line-art illustration and weaves the child's likeness into the story
  4. A physical coloring book is printed and shipped directly to you

Custom product notice: Because every book is uniquely generated for your child, each order is a one-of-a-kind product. Please review your order carefully before submitting.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

4. Your Photo & Content

Photo Ownership & Permission

By uploading a photograph, you represent and warrant that:

License to Process Your Photo

By uploading a photo, you grant Fun-o-matic Labs LLC a limited, non-exclusive, non-transferable license to use the photo solely for the purpose of generating your personalized coloring book. This license expires immediately upon deletion of the photo (which occurs automatically after processing).

We do not use your photo for advertising, training AI models, or any purpose other than creating your book. See our Privacy Statement for full details.

Photo Requirements

For best results, please upload a clear, well-lit photo where the child's face is visible. We reserve the right to refuse to process photos that:

If we are unable to process your photo, we will contact you to arrange a replacement or issue a full refund.

Photo Deletion

Your original photo is permanently and automatically deleted from our systems immediately after your coloring book is generated. We do not retain the original photograph in any database, backup, or archive. You will receive a deletion confirmation email.

5. Intellectual Property

What You Own

You retain full ownership of the original photograph you upload. Your photo belongs to you.

The physical coloring book you purchase is yours to keep, use, color, and share with your family. You may reproduce pages for personal, non-commercial use (e.g., printing extra copies of a page for your child).

What We Own

Fun-o-matic Labs LLC retains ownership of:

Personal use grant: While we own the generated artwork, we grant you a personal, non-exclusive license to use the coloring book for personal, family, and non-commercial purposes. You may not resell, reproduce for commercial gain, or publicly distribute the book without our written permission.

Trademark

"Color My Classics" and the associated logo are trademarks of Fun-o-matic Labs LLC. You may not use our name or logo without written permission.

6. Orders & Payment

Placing an Order

When you place an order, you are making an offer to purchase a custom product. Your order is accepted — and a binding agreement formed — when we send you an order confirmation email and begin processing your book.

Pricing

All prices are listed in US dollars and include the cost of the coloring book. Shipping costs are calculated at checkout based on your delivery address. We reserve the right to adjust prices at any time, but the price shown at checkout is the price you pay.

Payment

Payments are processed securely by our PCI-compliant payment partner. We accept major credit and debit cards. By providing your payment information, you authorize us to charge the total order amount. We never store your full payment card details.

Order Errors

Please review your order carefully before submitting. If you notice an error immediately after placing your order, contact us at hello@colormyclassics.com as quickly as possible. Because production begins shortly after order confirmation, we cannot guarantee changes can be made once processing has started.

7. Shipping & Delivery

Color My Classics books are printed on demand and shipped via our print fulfillment partner. Typical production and delivery timelines:

Delivery estimates are not guaranteed and may be affected by carrier delays, holidays, or circumstances beyond our control. We are not responsible for delays caused by the shipping carrier once the order has been dispatched.

You will receive a shipping confirmation email with a tracking number when your book is on its way.

⚠️ We currently ship within the United States. International shipping availability will be announced separately.

8. Returns & Refunds

Custom Products

Because every Color My Classics book is custom-created specifically for your child, we are unable to accept returns on completed orders for reasons of preference or change of mind. Each book is a unique, personalized item made just for you.

Damaged or Defective Items

If your book arrives damaged, defective, or with a printing error, we will make it right at no cost to you. Please contact us within 14 days of delivery at hello@colormyclassics.com with:

We will offer a replacement or full refund at our discretion.

Processing Failures

If we are unable to generate a satisfactory coloring book from your photo (e.g., photo quality is too low for processing), we will contact you to arrange a replacement photo upload. If we cannot resolve the issue, you will receive a full refund.

Lost Packages

If your package is lost in transit (tracked as undelivered with no movement for 10+ business days), please contact us and we will investigate with the carrier. If confirmed lost, we will reprint and reship at no charge.

Our commitment: We stand behind our product. If you're not happy with the quality of your book, reach out — we'll work with you to make it right.

9. Prohibited Uses

You agree not to use Color My Classics for any of the following:

10. Disclaimer of Warranties

The Color My Classics service is provided "as is" and "as available." While we take great care in the quality of our product, we make no warranties or representations that:

To the fullest extent permitted by law, Fun-o-matic Labs LLC disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Fun-o-matic Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to:

Our total liability to you for any claim arising from your use of Color My Classics shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by law.

12. Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising from or related to these terms or your use of the service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in New York City, NY, under the rules of the American Arbitration Association.

You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will provide notice via email (if you have an account or recent order) or a prominent notice on our website.

Your continued use of Color My Classics after changes are posted constitutes your acceptance of the updated terms.
